I will, at the least I will annoy them to death. I have already had a senators aid contact them, filed a complaint with my congressman since it is federal money now, contacted the BOL and filed an appeal. I guess I am out of ammunition but maybe they will get this right somehow. Thanks for your help and I will update as I learn more.
I filed an appeal in VA, its was thrown out because they said I should have never been able to file for EUC in VA in the first place and the application was mailed to me in error(Which seems bogus that an appeal can be thrown out without due process). I wrote the governor and someone from VA contacted me today and said Interstate Claims denied me based on the fact that I received EUC in NJ, and it does not matter that they were separate claims. I have called BLS, emailed, left messages, I am hoping someone can point me in the right direction in finding the regulations governing EUC that states must follow. I have searched the forums and the BLS website and can't find anything I can present to VA that they are not following directives. I am fighting a monster in VA and need some help!

I am really baffled by this. We have not yet heard that because you were paid EUC by one state, you cannot get EUC from another state on an unexpired claim. States pay EUC on multiple claims in their own states provided bye dates are met. It would not seem that because, in your case, one is a VA claim and the other a NJ claim, the NJ EUC should preclude VA EUC. I think way back we had reports on this board of people reverting to older EUC benefits from other states.
Rattle another cage - make a lot of noise - and ASK VA if it will pay EUC on two state of VA claims? Every other state does every day of the week. That might give you a clue on how they are administering EUC.

The lady who called me today seemed genuinely mad at me for writing the governor on this issue. My thoughts are that one person doesn't know the law and everyone else just goes by what that person wrote in the file.

Right now BLS page is very slow. What you want are the UIPL directives at the bottom of the pulldown. Unfortunately, it's kind of like looking for needle in a haystack. Recent link off previous update to BLS page gives this:

Did you ask if they pay EUC on more than one State of VA claim - as every other state in the country does? The answer to that would interesting. If they say, yes, then why wouldn't they pay on your claim?
If you could afford it, just for the h*ll of it, you should file a lawsuit. Also, they should at least send you a formal denial. What are they afraid of?
I was so flustered I did not ask that question. I don't think it would have matter to the lady I was speaking to. She was reading me the decision so I asked if they could send that to me since they never did and she said no. So I ask if she could email it to me, she said no. I then asked if the only way I was going to get this info was to file a law suit and have her email subpoenaed so I could see the logic of denial. That's when she told me I should go to law school so I wouldn't have to file for unemployment again.
She was surprised to find out I graduated law school 12 years ago...
I think I found an answer for you an your ability to appeal your denial of EUC08 in VA.
From page A-9
a. Determination of Initial Claim. When an individual files an initial claim for EUC08, the
state agency must determine promptly the eligibility of the individual and, if eligible, the
weekly and maximum amounts of EUC08 payable. If denied EUC08, the individual
must be issued an appealable determination.
You have to get your hearing, and now you have the authority of the US Department of Labor behind you.
Also, there was just a ton to read, but there was some Q&A's about how to handle a combined wage claim. I think that is the place to start.
Thanks for the reply, for Va. purposes they are saying my initial EUC08 claim was in 6/12 when they issued a denial based on wages in NJ. Their reasoning for not issuing a formal denial on this occasion is that the EUC application was sent in error, there was no denial, its like the application never existed.
