Congress Passes Benefit Extension - Updated January 2, 2013

Congress passed the American Taxpayer Relief Act of 2012. The President is expected to sign the bill into law as soon as today, January 2, 2013.

The legislation would not change the number of weeks of benefits available under the EUC program, but would allow the program to continue the same as before. We will update this page with details as soon as possible after any law is passed.

Please continue to claim weekly benefits in the usual manner, unless you receive instruction to file a new claim.

Keep checking this website for updates on the benefit extension and further instructions.

Please note the Extended Benefits (EB) program ended in New York State on December 9, 2012. At this time, we do not expect the EB program to return, even if Congress passes an extension of EUC.

Additional information is available here: http://labor.ny.gov/ui/claimantinfo/ExtendedBenefits.shtm

I read in a comment on the NY DOL Facebook page that the only reason the December rates went below 110% for EB was because EB was cut completely in the beginning of December. People are asking that you sign a petition:

It was below 110% when the TUR's where released (went to 108%) on October 21st. One had nothing to do with the other. The only reason it ended on December 9th was it was in the "13 week Mandatory ON period". If there was no such "Mandatory ON" period it would of ended October 21, 2012 for New York.

Petition won't go very far. NY UE rate is 8.3%. NJ is far worse at 9.6%.

Also, EB has been on its way out since December 2011 - when Congress failed to increase the lookback to four years in the 2011 short-term extension of EUC. No state meets that 110% criteria any longer.

Should UE rates rise dramatically in any one state, then, perhaps, that individual state might again trigger on, as NY did for three months beginning in September. NY has again triggered off as of 12/9.
