Many lawyers aren't going to take a case like that. It's not worth it for them. If legal aid handles cases like that, go for it. Lawyers are all about money. I would move on, but definitely learn from this major error in judgment. If the DOL regulations mandate that you take a cut based on the last job held, there's nothing you can do. You can have an appeal and hearing internally with DOL but I'm sorry to say, I doubt you will win. You can try, but if they establish you were wrong, then you gotta take the hit. New York is a rough state when it comes to gov't agencies.
