While I was receiving unemployment in California, I put down my current employer for the section at the bottom asking if I'm working/making money. The only problem is, I'm 1099, and apparently should have been putting freelance, or actually "Piece Work." My employer found out, and is mad and claims he'll be audited now (I'm being switched from 1099 to taxes being withheld). Can I retroactively put down that I was freelance instead of using him as my employer? Thanks in advance!
You might, but why try? Being 1099 is usually to the employer's advantage not yours. Many employer's classify as 1099 when the person should actually be on w-2. Let the employer be mad. They were probably doing something slimey and that's why they changed your status.
I agree that the employer is a DB and I have little to no respect for the guy. My fear is that the work will stop, and as much as I hate the guy, I'd like to continue getting the pay check.
Thinking about it, it wouldn't matter. If you'd filed your initial app with only the name of the former employer, you'd still be reporting this current employer on your continued claim form as you reported your earnings weekly.
