Good afternoon,

I recently was forced to resign involuntarily from my job. I had to have Carpal Tunnel Surgery and was taken out of work due to the nature of my job. I had gone to my job to give them my doctors note stating I would need at least another two weeks until I could possibly return to my job, again due to the nature of what I needed to do. When I went to my job to give them my doctors note, my manager typed up a resignation letter and I signed it due to the fact that I felt I needed to in order to possibly be able to return back to work there. On 7/13/15 I was forced to resign (Manager wrote the letter), I applied that day for unemployment benefits. I got denied and requested an appeal with a lengthy explanation as to why I wanted to appeal. I received a call today from the unemployment office for the appeal hearing over the phone 8/25/15, explained the situation in detail again and was told I was approved for the benefits based off of my situation (its a very long story and i'm trying to not make it a huge thread lol). I have been able to work but just not able to perform my job duties that I needed to do. My question is, since I was told I am now approved for benefits, what is a realistic time frame of when I will be receiving my first payment? Please feel free to share your stories! Any input is greatly appreciated.

Please don't use the the term "resign involuntarily," with your family and friends. In the world of UI, it just plain doesn't exist, and no matter how much you say it, it won't make any difference. As proof, you were denied the first time around.

It's hard enough for people to get benefits that they don't need to read or hear something that was of no help.

Next time, tear it up. Make your boss do her own dirty work and fire you, and again, tell all your family and friends so that people will stop getting duped out of their UI benefits.

The lengthy explanation got you no where. Next time, "the determination dated mm/dd/yy is wrong. I want an appeal hearing scheduled." The proof is that you had to attend a hearing any way.

So why did you win? Was it a quit with good cause because of your carpal tunnel or was it a "quit in lieu," because they believed that your employer was going to fire you anyway unless you quit?

Depends in the state, but don't expect any money in less than two weeks.

Next time you think you might need the UI system, come here first. We could have helped you get benefits from the beginning and not have to go through what we call "the unnecessary appeal."

Thank you for the quick input.

I won because it was a "quit in lieu". Basically, if I didn't sign the resignation letter, I wouldn't of had the possibility to go back to work there. It was a very awkward situation. Also, during the hearing he stated he is granting me benefits due to the fact that my manager wrote out the resignation letter and stated that I was the one who typed it up and resigned willingly. I wish I had found this website prior to me applying because it would have made the process a lot easier.

I have another question, if you don't mind. About how long after the hearing will I receive the determination letter?

I would have loved had you torn it up. Just imagine a claimant saying, "I was fired because I tore up the letter of resignation my boss wanted me to sign." Then having a boss trying to spin it into insubordination.

In as little as tomorrow's mail and as long as 10 days. Just depends on how long they have to think about it. Yours will be really fast.

That would have been great lol I wish I knew more prior to handling this issue.. I was really taken back by all of it because it was so unexpected. Thank you again for all your help!!

Just as an FYI - being approved for benefits after an appeals still does not always means you will be paid for the time. You may get a favorable determination on the question of the quit but have the payments withheld due to able and available. You may have to fight a second battle.

Update:

I called the unemployment office and spoke to them about the hearing officer telling me I was approved, and they confirmed that I am approved and will receive 5 weeks of back pay. I have direct deposit with my bank and they told me they are releasing the payment for multiple payments tomorrow and should receive payment within 3 business days!!!

I was told that I am eligible for payments.

I sure hope I don't have another battle to fight.. But, I do know that my employer has the right to contest this decision as well. I really hope that doesn't end up being the case.

This appeal hearing you had was the most important in the whole process. From here on out things are very much in your favor. It's not impossible for the decision to change, but the percentages are in your favor.
