Hi,

I worked at my place of employment from September up to December. In that time I never had a write up, I was given excellent reviews and great reviews from customers. Back in December I did an incorrect return which caused LP (loss prevention) to take me to a room and interrogate me. They accused me of stealing and when I proved them wrong they brought up "well you did a return wrong" which caused a loss of $35 and stated I broke the rule of "ethics". This happened on a Friday in December. I signed a paper saying I did purchase the items that they accused me of stealing. I was never suspended, etc. I returned back to work that Saturday. My next shift was Monday and as I was walking into work my foot got stuck in the ground which then I fell forward injuring my knee. I was brought to the ER and was told I couldn't work until I saw a orthopedic doctor. My job never called to check on me, ask me to come in, etc. I am also currently dealing with workers comp too. Fast forward to January 14th when my boss started asking me when I'm coming back. I needed the money so I told her I would come back, but with my injury I couldn't stand for a prolong period etc. I am a makeup artist so I need to be on my feet all day. She was fine with this, so I agreed to come in. ( I'm still on a no work note from my doctor which they knew). As soon as I got into my job she brought me to my GM and that is when they fired me. They stayed they were going to fire me the date of my injury, but they didn't.


Now, I've been collecting unemployment since my February heating. I told the UI person on the phone this information and she awarded it to me. I am still injured, I am currently fighting for my workers comp benefits with my lawyer. I do have a torn meniscus and require surgery.

My main question is what are they going to do with the appeal, if I lose am I responsible for paying back the awarded money I've received?

I'm just nervous as I am injured and even though I am on light duty I am having a hard time finding a job that will accommodate me knowing I have a previous work injury.

Did you get a letter telling you WHY the employer was appealing and what did the employer have to say?

Yes, they were saying I was terminated due to "violating" their ethics policy.

Do you mean "hearing"? Did you really have a hearing or was it a phone interview?

It was a phone interview and they asked me why I left my employer. I told them the above information and I was then awarded the unemployment based on info that my previous employer sent as well as my phone interview.

Your story doesn't sound bad, and "ethics" isn't necessarily misconduct. If you do something often enough, eventually you're going to make a mistake. I think the employer is just making it sound worse than it really is. Don't let them.
