Our family is relocating from North Carolina to California for my husband's job. I have to leave my job in order to relocate with his. (His pays more...) I've heard that I can collect unemployment because of this. Is that so? I've called CA unemployment, but have not gotten a straight answer. Any info would be welcome. Thank you.

When I left my job in NYC and we moved to FL, my spouse was eligible for NYS unemployment benefits in FL. I would assume most states work that way. When it's not a job loss due to YOUR own fault, you can get the benefits from MOST states.

If you're REALLY interested in the provisions under which individual states allow unemployment claims when employment is left volountarily - here's the link

I love people who think they know everything.

The actual wording of unemployment collection rights is that you "can not leave a job voluntarily WITHOUT CAUSE and collect unemployment benefits".

There are several circumstances that fall into the WITH cause that would allow you to quit your job and collect. One of them definitely is when your spouse is relocating for work far enough away that you can not commute to your current job.

END OF STORY.

NEW but similar topic:

Can my husband get unemployment benefits from PA if his PA employer forces him to relocate (still within same company) to Delaware or Mass. against his will? We would be taking a major paycut, due to additional income taxes and added expenses. We know we'd get a refund for the additional taxes Delaware and Mass. withhold during tax time, but we need the $$ each week, for expenses.

Isn't his employer adjusting his wages for the higher COLA in MA?

Also, if you know you will get a refund, why not adjust the withholding immediately? The amount withheld is determined on the W-4 competed by your husband and submitted to payroll. Just increase your deductions. His take-home won't change. I've never had substantial tax refund in my life. I calculate what I will owe and have employer withhold only that and no more.

To answer your question, if company relocates to another state a far distance away, your husband has reasonable grounds not to follow. Call PA for definite info on their guidelines.

Is he that confident he will be reemployed in your area? If you are worried about expenses because of additional withholding, what are going to do when he is collecting unemployment which will be even less and remains unemployed for along time? There is no guarantee Congress will extend benefits in 2012.

Most states allow this as a legitimate quit. Check the MN website or call them.

Besides CA owes her nothing.
You are actually wrong, if your spouse has to relocate to another state for work and there is no way to transfer or commute to your job you can collect unemployment. It's called quitting your job for a legitimate reason.
