I have the same situation on my property. In my case it's the opposite. I now own a section of land that was once owned by a neighbor. I didn't put claim to it, it was the previous owner who did. I would have had no problem giving that land back, but the previous owner put a well in on the section of property that feeds the barn and house.
Another thing that is simple to deal with, but often times overlooked is posting your property during hunting season. We had a rare breed of cattle on our land as well as our kids playing in the fields, when a group of hunters set up on the edge of our wood line. I called the Fish and Wildlife and they informed me that unless the property was posted, the hunters had every right to be on my land. I didn't really care but was concerned for the safety of the kids and the cattle(which were a small breed and resembled deer).

I asked them not to hunt on our property while the kids and animals were out. The response given was, your land isn't posted. That's when I called Fish and Wildlife. Within a week we had the land posted, although that didn't stop our issues. After we posted our land we had hunters jacking deer after dusk. The Fish and Wildlife told us not to attempt to stop them.

Hmm. Most will leave if a property owner asks. I wouldn't confront poachers either (jacking deer at night qualifies as poaching), they can be dangerous.

WoW! This is some good information! I know lots of abandoned properties...lakefront and all! So, if I decide to start "using" the property......I will eventually own it? LOL Gotta love some of these state laws!

You have to pay taxes on it and claim it's yours. Open and notorious.

It think thats stealing unless the new property owners agree, in fact I think it's mooching, living for free because a person it to lazy to work to own!

That's a fair point but not knowing what went on between 68's previous owner and the neighbor regarding this land use change I think it's passing a harsh judgement without knowing the facts.
Perhaps the neighbor had no use for this piece of land and since it would help provide water for 68's previous owner the neighbor gave his/her blessing.
Wouldn't the neighbor with the reduced acreage in the deal have lowered property taxes?
