I was pulled over awhile back for speeding and the officer thought he smelled marijuana in the car. He searched and found a small amount of what he thought was marijuana under the passenger seat. I think it may have been salvia. I was giving a ride to someone from craiglist (i was driving from nyc to atl) and believe it was his. He was with me and was never questioned.
I have my court date this week and am eondering how the prosecutor will present the evidence if at all. I have received no notice of evidence for the case. I would like to prove it is salvia. Also, my case for speeding is on the same day. Will the judge assume a harsher sentence since he may believe i was smoking and driving? Thanks,

27, distric court only, its in va and i see lots of legal questions on here, not gonna hire an attorney

How can you try to "prove" it was salvia when you admitted that you only "believe" that it was salvia? Did the cop confiscate that (whatever it was?), may be she/he will bring to the court as evidence?

Also, not trying to judge here, but the whole "giving ride to someone in Craigslist" sounds like a poor excuse for the whole weed-possession thing, if I were the judge, I sure wouldn't believe a word of it unless you have some more compelling evidence to prove your case? Did you tell the cop that you "think" it belonged to the person you were riding with, in that case, why was he/she not questioned? Again, not trying to judge you here, just saying that if I, an ordinary person, feels this way, the judge is probably going to be even more strict about it. CAVA is correct, you should try to hire someone to help you in this matter!!
