Yet another reckless driving thread (106/65)
Me and my girlfriend went out to PA for the day (some weird city she wanted to visit, Centralia I think it was, and seeing how she has me whipped I obliged), and on the return trip back to Williamsburg we got pulled over doing 106 in a 65 zone. It was 2 20 in the morning according to the summons, and there was maybe one other vehicle in the vicinity, not including the cop. He pulled me over asking if I knew how fast we were going, which I answered "no" to. He then asked for my license and registration, telling me that I was being "summoned" for reckless driving saying that I was liable to pay up to $2500 in fines and up to a year in prison. He went back to his vehicle and came back with the summons about 5 minutes later, and that was that.
I'm 18 years old, 19 on the 21st, and I was wondering what the likelihood of me getting jail time is. I have no Criminal offenses or ANY other traffic violations.
This was in New Kent county, and I don't know if this means anything or not, but he marked "General District Court (Traffic)" instead of "General District Court (Criminal)", since I think this counts as a misdemeanor.

Every mile over 90 is eligible for one day in jail in Virginia so at 106 the worst case scenario for you is 16 days in jail with some high fines.
Even so jail time is not likely for first-time offenders. My advice is to consider hiring a lawyer which is expensive but a reckless on your record is VERY expensive. Refer to some of the other VA reckless driving threads on here for more advice.

What Alanboy stated is not the law in Virginia, it may be a particular judge's practice to do that where he lives, but it is not the law. Where I live in Virginia the judges here would give you at least 10 days in jail. It's all at the judge's discretion and he/she could give you then entire year if he/she wanted and there's nothing you could do about it but appeal to the circuit court. Or the judge could give you zero time for it if convicted. Also be aware that on misdemeanor time you do 50% if you behave while in jail. So on a 10-day sentence you would actually only pull 5 days. I'm not trying to be mean or to scare you but bring a tooth brush when you go to court because there's a decent chance you will go to jail.
