Default What are my options?

I live in Washington State and I am currently under a 12 month lease with about 4 months to go. My live-in boyfriend and I have broken up and he is not on the lease. I would like to know if I want him out do I have to serve him legally with a 30 day written notice or can I just make him leave?

Several ways I can think of...

Convince him it is in HIS best interest to voluntarily leave... because staying is not an option.

If he is violent, get a restraining order and he will be out.

You could go the legal route as far as an eviction... but that would be my last resort with 4 months left to go...

Will your local police department assist by having a talk with him? Some will do this and others absolutely will not.

You need legal advice. There are strict rules to *booting* someone out of your apartment. You can check out http://www.nwjustice.org/ for self-help legal information as well as landlord tenant issues.

P.S. it doesn't matter if he is on the lease or not.. if he has been living there and he isn't hurting you, you can not just boot him out.. find out your legal rights first before you do anything that may get your in trouble.. good luck

as a law student you tell him to leave and if he dont do it by the time you told him he needs to be out , give him the the 30 day notice and get a police report as a back up it comes in handy. but do remenber it can get ugly , he might try to do something to you or the apt because you told him to leave, so be aware.

I tried to help a younger guy I worked with for a while - let him be a room mate. Family is the cops - I couldn't do anything to him without a leagal 30 day notice even though he never paid rent. As family said if someone sees his vehicle at your door more than 7 times a month and has a toothbrush you can not get the cops involved. Turns out he was a little user and knews this.

So I got a mutual friend to come over and give him the reason that he didn't want to be there anyomore. He was gone in a day. If you do give notice get it notorized so no question when that day is.
