Are clean but used mattresses legal to sell in either a yard sale or a store?

I do not know this answer, but I've seen people sell a bed with a "free" mattress and have the price reflect the true value of both.

I know the donation type places won't take them b/c they can't resell that's why it's a plus when the mattress store offers "free removal".
