First let me say hello! Well I seem to have a problem. My apartment was recently found to be illegal. I was notified about this around January 7.I received a letter from the city inspector i had come to my apartment(hole in bathroom floor that landlord hadn't fixed for 6 months) around the same date.The landlord gave me a letter stating that he needed me to vacate by the 31. I explained to him that I needed a full 30 days so we agreed on February 7. Well today is February 7. And honestly i haven't been able to find a place in my price range that will accept a one shot deal. So obviously I am still occupying the apartment. I just would like some advice on what I should do and what can be done. I just need some advice. This was my first ever apartment. I had been told many things about back rent and such but was told that since my agreement was month to month and not a lease it doesn't apply to me. I really just need a place to live. Please help if u can. Thank you.

Well you really need to get out of there.

Have you been in touch with realtors? If you need something really quickly I wouldn't deal with management companies as they tend to take a while. Another apartment in a private home would probably be the quickest way to find something.

Find a real estate lawyer if the landlord continues to go after you for that back rent. If the landlord wants it, then that landlord should be considering bring his/her property(ies) up to code. You shouldn't be paying rent in something the city won't even let you occupy.

You need to leave that apartment as soon as you can. Look on Craig's list for apartments.

hi everyone also I also have been put in same cituation however I don't have landlord issues hes also my Uncle the prior tenants were tenants from hell they filed a complaint with city and they now are telling me that I m gonna have too vacate in thirty days ... I am aware of" illegal" aptments as their called but I also have heard that owners can just register the apt under code? is this true and were wud I find more info ... when searched all I get is this info too your question im not a lawyer but im pretty sure they wud be liable for all money procured for the departure too new place .... what boggles me is if they told u 30 days ?? and ur still their?? you shud google Squater rights I wud of thaught if the city came too tell you 30day vacate they wud have padlocked the door after a month

I agree the squatter rights however from a source was told from inspector I know that they have too follow complaint but its not like they go looking for this they understand everyone does this if you ignore them they will just let it go after a couple of attempts "No Contact" they got bigger fish too fry not a working class person tryn make a lil extra too survive

I sympathize with your situation. As for the comment about padlocking your door, memo -I do believe that under no circumstances is anyone ever allowed to do that. and having been a landlord for more years than I want to admit to t, and in yonkers as well, and having tenants from absolute hell, the courts were always on their side. As a landlord I was Frequently cheated and abused by tenants who looked perfect when I met themi.with great(phoney) references

Pad locking the door and getting them out would have been a blessing for everyone else surrounding them but the courts would never let you do it or the police.
