Can anyone advise resources available/direction as to the liability and/or how to get NC assistance with a storage facility that experienced water and mud damage in 90% of the units and mold growth as a result and who have been unresponsive? I do not know where my lease is but have been told that since one of the Owners is an attorney who probably has written in any conceivable out for liability and probably is the basis for the lack of concern for my thousands of dollars of loss as well as not providing any assistance in mitigating the growing mold situation (and the one that I have been trying to take action/mitigate water/mold damage since first advised storage facility last Tuesday 4/29). Since the units are all connected the mold spores in one will travel over the ceiling openings to all of the other units.

Check with your homeowners insurance. At least some of your loss should be covered. We are renting a storage unit and it's automatically included in our HO coverage.

In NC, you should have been offered renters insurance when you rented the unit. If you declined that offer, it should have been noted in your contract and you would have had to initial it.

If the OP owns a home and already has homeowners insurance, renter's insurance is not necessary... kinda like renting a car and being covered by your existing auto coverage. The amount of damage covered would be dependent on the individual policy's limits.

Many renters do not own a home, and are free to get insurance as they choose. I was slightly mistaken in that it is not an official law in NC (as it is in some other states) that they be offered insurance when they rent the unit. In addition, the insurance is not directly through the storage facility but is offered through a 3rd party company that specializes in such. Most professional / brand name chain storage facilities will mention this when renting a unit. If you're renting a unit from a side of the road place that doesn't even have a gate or access control system, then you're not likely going to have it offered to you.

Bottom line is, don't expect them to pay for any damages. They are not a bailee and are not responsible for your items.
