who has been with the company the same amount of time as you getting promoted before you just because he kisses more ass than you even though you do more work?

I wouldn't promote neither one. At my company, promotions are given to the best qualified, not who can brownnose the most.

Do you own that company? The human factor is key in all organisational life. Like it or not, nepotism happens, and is to some degree understandable.
