It varies by state. I've heard in California that all a former employer can say is that someone is rehireable. But in my state, former employers can say pretty much anything that they want. But sure, companies can have their own individual policies. However, there typically isn't a way to ensure that the policy is enforced. Only when someone sues is when a company finds out that one of their own didn't follow policy, and by then, the former employee's chances for a new job has been compromised.
