I understand by law if you are exempt your employer is not required to pay you overtime pay, however, if it is worded on your contract that they will pay you a standard rate past 40 hrs it is up to them do to so.

My current situation, I'm exempt and on my contract it states I would be paid a standard rate for anything past 40hrs, well now they are not willing to pay me past 40 hrs....
What contract?

Don't have one, and yes, I work more than 40 hours as a matter of course, and I don't get paid anything extra.

Yeah, if it is in your contract then those are the terms. So can you just do billable projects for all hours worked over 40?

Based on how you described your job, it sounds like you are doing exempt level work (using discretion and making decisions, independently choosing one course of action vs. another where making the wrong choice could significantly impact business operations). So you are not eligible for OT pay for working over 40 hrs as an exempt employee, as the others have said.

As far as finding a new job...if you do the same type of work anywhere else you're still going to be classified as exempt. I (and many others) an an exempt employee who puts in >40 hrs/week and gets NIL for it...getting something is better than nothing! GL
finding new work would be taking a promotion for me, it is the only way id leave here, and is not motivated by money (a minor thought), it is motivated by responsibility and professional growth.

not all work i perform is billable. i do exempt level work, but i want to do more because i know what my potential is and im no where near it. i have a game plan in the works, and i would like to own my own company, but there are necessary steps before i get there.
