I learned over the years the word "optional" in business is a political correct term for required.
Does the form not allow you to decline? Because I always refuse to answer that question, and there's *never* been a time where I was unable to complete the application as a result. This was also the case when I worked in HR - it was optional and stored separately from the applications.

They call it equal employment opportunity/diversity but that is bull. The resumes posted on Linkedin and Indeed tell the truth. Employers can clearly see this information because it is a part of the application. How can this crap be legal? It does not say anything about the federal government.
It's mandated by law for employers over a certain size. I put white on everything when applying.
I turned in two online applications for the same job once. (on a site where the application is on file)
On one I put my race was White and the other I put Black.
My application where I was Black was denied because they went with more "experienced" candidates but my white application was approved and I was scheduled for an interview.
I ended up going to another interview that same day for a job I really wanted. I did call to complain and wrote a letter to the company head.
The head gave the standard apology and promised to follow up. About 2 weeks later I received a letter apologizing for an HR oversight and asking me to come interview for another position that was opening up in a month as they believe I would be a great fit to their company.
Whoever says race isn't given to HR is definitely lying.

None of the hiring managers or others involved in hiring decisions are able to see that information. It's not stored with any names, just for compiling numbers. All big employers do it, on a form to provide data to the federal government.
Yeah that is bs. All that does is tell someone how many blacks,whites,others applied for a job. Doesn't tell how many blacks,whites,others are hired. Who is hired is what EOO is all about.
Age and Disability is also asked and those are supposed to be illegal too but they are still there. Yeah they use screening techniques to get around it but in this economy they just do it because they can.

I pulled my mortgage application and it does ask for race. Again, it states it is optional but strongly cautioned. The blurb was rubbish. I guess they can get away with it if they state discrimination is prohibited. I can not believe this is legal but who is going to challenge the federal government?
When I worked at the bank we still had to mark your race even if you declined to state. You may decline but nothing prevents someone from noticing.

I wasn't receiving a lot of call backs and my sister told me to change my race on the applications (that's what she did). I didn't think it would work so I went back and submitted the application again.
I should add that the application I sent for the other same day interview listed my race as Black.
