JDIMYTAI DAMOUR WAS TRAMPLED TO DEATH BY BLACK FRIDAY SHOPPERS IN 2008
WASHINGTON -- This coming Black Friday will mark six years since a worker died beneath a throng of shoppers at a Walmart on Long Island. Although federal regulators faulted the retail giant in the tragedy, Walmart still hasn’t been compelled to pay the modest $7,000 fine that was levied against it.
So are you going to post articles of every company that is currently on appeal for fighting a fine that is crap? Even the article you posted states that Walmart is handling it like other companies. Also how was walmart to know that the public morals have went so far down hill people were willing to trample others to death to save a few bucks? If I remember right it was the 1st time something like this had happened.
Walmart has much more at stake than 7K. Any major retailer would be doing the same thing.
Correct.
Large entities have to view lawsuits not on terms of 'the lawsuit' but what happens if they make it known that they're handing out checks to anyone who files against them. Suddenly the 7000 lawsuit morphs into tens of millions, every year, year after year. Lawyers who take cases on contingency do so on the basis of the likelihood that the respondent will settle.
To put it another way, lets say you are in a car accident and the other guy is at fault.
If he has Insurance X, you are MUCH more likely to get an attorney to take your case than if he has Insurance Z. The resut is that Insurance Company Z has a reputation among lawyers that they will fight tooth and nail on a regular basis, thus it becomes extremely hard for you to find one to take the case without coming out of pocket. This radically reduces the amount of people who are able to sue them.
there is no way to prevent incidents on black friday as all the animals come out for sport
many will even start fights on purpose
i just like many have worked retail before and have witnessed the animal behavior on black friday
in regards to walmart
$2mil is always money well spent... a large corporation like walmart has a legal team on deck. you cant have a situation where people purposely come into the store *looking* to get paid off of falling in the store or some other ish that will end up costing you much more than a measley $2mil
