On April 24, 2015 the employer had the 2nd shift clock in at 12:01 Friday night Saturday morning when our normal clock in time is at 9 or 10pm so that we would'nt get over time. Our time initially went in on Saturdays and the work week begins on Sunday. So we were thinking that we would have a 6 day pay check getting the over time anyways. When we get to work today April 27, they changed the day that the time go in to Thursday and the work week begins on Friday stopping us from getting the over time that we earned. Is this legal?
You should probably not use your actual name, if that's what you did.
If they changed the time your shifts started and ended, that's legal. If they altered your time cards so that it does not reflect when you actually worked, it is illegal. I'm confused as by your description as to which of those things happened.
They can't change their pay periods retroactively, but there is nothing to stop them from deciding that their business week stretches from Friday to Thursday moving forward.
That Saturday would have been on a separate check from the rest of your work schedule being from Sunday to the following Friday (?). And why can't they shift the days the pay period starts and ends?
At my current job, our work week starts on Friday and goes to Thursday. It's been like that for many years.
Also, at my job, it's possible to work ten days in a row without getting overtime for a sixth day. So if I work if I start off with a Friday and Saturday off with working the next five days in a row... Sunday, Monday Tuesday, Wednesday and Thursday (five days in a row during this first pay period) and then for the next pay period work Friday, Saturday, Sunday, Monday and Tuesday with having Wednesday and Thursday off, I don't get any overtime for working a sixth day.
It doesn't really bother me to do this once in a while since I get paid enough to begin with.
