If you are on a job less than 1 year can a company fire you or not guarantee your job if you need cervical fusion surgery and you could be out of work for 2-3 months.

I know after a year there is the family leave act that garantees your job for 12 weaks. Hopefully I can get by without the surgry but I have cervical disk problems

Union they keep you and pay you for the time you are ill. Non union, sorry you are fired!

Even if you've been there a year - they don't have to guarantee you a job past the 12 weeks of the FMLA ??

You could work for them for 10 years, and post 12 weeks of FMLA - if they want to get rid of you, they could..

Of course that depends on what kind of employer you work for, what skill set you have and everything else.

But unless you are the rare person who has a CONTRACT - you're an at-will employee, and after giving you 12 weeks to get better - they can dismiss you.

If you really need to keep this job, I would down the medication and try to last until the one year mark. I would also save up your vacation and sick time because they will use that time during your leave so you can get paid for part of it but once those run out, you will be off work with no pay.

I believe the max time allowed is three months per one year.

If you have been at the job for less than a year what benefits will you lose by leaving and having the surgery? Do you have medical insurance where you work and is that insurance going to pay for the surgery? My thoughts are that if you have been there less than a year then chances are you have little invested with the company and could either re-applly with them at a later date or move on to another company. I bet you were looking for a job when you found that one.
