I wish one of my ex-employers owed me money. Must feel good to know what's in someone elses pocket belongs to you and will be in your possession eventually.
I know a guy in a similar situation. We worked together back in 2010. In September of that year, he left the company and was owed sales commission. I ran into him last fall. The company had gone out of business in 2014. He was still trying to get the money.
When I left the same company, I was owed 10 weeks straight pay, not commission. First week after I left I got paid one weeks pay, nothing for two weeks, another weeks pay, nothing the next week and so on. Finally DOL found out the employees were months behind in pay, and the owner was forced to pay everyone what they were owed. I received a lump sum for the money I was owed, and not long after that the business closed.
Send him another email or a letter if you have doubts he may not get the email. Just state that it has been x weeks since the commission was earned and if you do not hear back from him in a week you will have no recourse but to contact the state labor department (or whatever office it is in your locality that handles such matters.) That will get his attention and unless he is completely broke you'll get your money. If not, you go to the state and file a claim but that will take much longer. You want to get paid, not get in a pissing match.
