So this is interesting scenario . Very interesting

Lets say a worker we will call Amy works for the government. Amy is permanent position is downtown at a Government building. Weekends off, day hours. Amy has been at the spot downtown for over a 1 year. Amy also have the least seniority out of the workers in her department

Now lets say we have Tom who works for the same government as Amy in the city. Tom department is short of workers due to firings and people who quit The department have been short for months and lots of workers have been racking up overtime in Tom's department. Tom also has applied for a transfer to where Amy works lots of months ago

Ok now in Amy department a worker has quit months ago. Just as earlier this month Amy and the department was gave a heads that Tom transfer was approved Feb 1st or so to work in Amy department to replace the fired worker so to say. (Now Tom department is very short of workers and they work lots of overtime and his transfer was still approved<---this part is important).


Toms arrived at Amy department lets say Feb 15th, everything is good but Amy still have less seniority.

Now here is the kicker! Amy was notified 2 days ago that Tom old department is so short of workers and they are tired of paying overtime. Since Amy has the less seniority in the department, Amy now have to transfer to Toms old department permanently and now she doesn't have weekends off but still work days

Moving people around to different departments when 1 is short is normal for the job and hours and days off may change but what is odd is why would they move Tom from the short department to Amy department only to tell Amy she will have to help out at the short department 2 weeks after Tom arrived. Now Tom have the good days off and Amy has tom old days off which is weekdays

Now why would they approved or move Tom to Amy department if they already knew in the mean while that they were very short of workers in Tom department only to move Amy to Toms departments weeks after Tom arrived from the short department to Amy department


Amy is very upset and talked to union reps and other big wigs. Amy thinks they want women out of the department she was working in. Amy also have a meeting with human resources in the upcoming week to express her concerns and see what is going on.

Now to you all does this sound very fishy to you? Why move Tom from the very short staffed department to Amy department only weeks later to move Amy to Tom department??

Amy may bring up a lawsuit but she is afraid of job retaliation. Since Amy has the less seniority in the department she have to move to Tom department.


Now the Union rep said they may say well we can move you wherever as you are needed. But how is she needed if you moved approved transfer one person from the short staff department to her department then her to the short staff department. Why didnt the person stay int he short staff department. They knew they needed people there for months..

Which job has more responsibility? It does sound as if his entrance and her exit were pre-planned

If that organization is seniority based and consistently practiced then it would be difficult to make a sex discrimination charge.

It doesn't read that Amy suffered any actual (monetary) damages anyway so nothing to sue for.

Only remedy available is through her organization and Union.
