An Ocean City lifeguard who sued after being fired at age 52 when he failed a swim test by three seconds has been awarded $127,998 in his discrimination suit.
Paul McCracken lost his job on June 27, 2011 after the city toughened fitness requirements for all lifeguards, according to the lawsuit.
This gentleman fought for six years to get what? $127K total settlement? Yet, he'll only see a fraction of it after income taxes and paying for his attorney. Hardly worth six years of one's life.
If we really want to stop age discrimination it should of been 1.27 million and the top employee of the organization, as well as every employee directly involved, should of went to jail.

While I don't agree with the jail sentence piece of your argument, I do agree that the price has to be high in order to discourage this behavior.
If they have a fitness test for a job like this, and the test is failed, the person should not get the job. Aging sucks, but it's part of life. Get a job where you can meet the fitness requirements.
