That's awfully harsh. I suspect it was really a different kind of leave (nothing illegal about that) but the OP is remembering it as short-term disability (without realizing what that means).

In my state we get 10 weeks of paid family leave. Right now we can get 55% pay, but once the program is fully rolled-out in 2021, it will be 12 weeks at 67% pay. We can take it any time during the first year of the baby’s life, so the parents can use their leaves consecutively if they want to.

I never had a paid maternity leave. I had 11 kids born between 1986-2003 & went back as soon as I could. That meant a day after giving birth once.

Had a lot more to say but generally, people aren't welcoming of my STRONG opinions. Just my weak ones.

I don’t think we get paternity/maternity leave, aside from the option to use accrued leave or FMLA.

It definitely could have been. I can't remember much about the specifics about when it happened since it was 2 years ago.

If it's a self funded plan, the employer can make any exceptions they want. The insurance company is just an administrator enforcing the rules the employer wants in effect.

We just get the FMLA: 12 weeks unpaid. If we have vacation time accrued, we have to use that first, and that's deducted from the number of unpaid weeks. For example, if you have 2 weeks of vacation time accrued, you first use your 2 weeks of vacation, and then you can get 10 weeks unpaid. I think women who give birth are allowed time off under the short term disability policy: you first have to use 1 week of vacation time (or 1 week unpaid), and then up to 12 weeks at 60% of your usual salary. I don't know how it works, but I seriously doubt that women who give birth are allowed 12 weeks of disability.

Recently, New York State added Paid Family Leave. No idea how it works or what it covers. All I know is that we get a deduction from every paycheck to pay for it. We were never told what it covers or how to use it. No idea if it's only for women who give birth or if it's also for fathers.

Both parents can use it after the birth, adoption, or foster placement of a child. It can also be used to care for sick family members, or for when a spouse is deployed. The main difference between this and FMLA is that you are paid during leave without having to use your PTO accruals. Not bad for 0.153% payroll deduction, although you can choose to opt out if you want to.

I don't know how many weeks we get (too old to worry about it lol) but I know we have at least one man who has taken paternity leave and is planning to again in a few months. His wife works here too. She takes however many months first, then she comes back to work and he takes his.
