Not unless they agree to it, or they get a judgement against them ordering it.

Hopefully, labor officials can get it out of him. Having to hire an attorney will eat up a lot of your money with no guarantee of success. Good luck on this. I got stiffed by an employer who later went bankrupt. He was an alcoholic narcissist who stiffed everyone in town.

I would go with the Wage and Labor board first.

If this is another one of those ****ty recruiters, they won't like the govt sniffing around their business.

Infact, threaten them with going to the Wage and Labor board. If you don't get your dues in a week, then reach out to the board.

Not in the US. You might be confusing this with asking for the defendant to cover your attorney costs in the event you win a lawsuit along with other damages.

I wouldn't threaten, I'd go report it first.

A lawyer letter isn’t necessary. Send the demand yourself and also add that you “reserve all rights to enforce all rights and remedies available under applicable law”.
