Default Employer deducted garnishments but did not pay creditor

Employer Deducted Wage Garnishment but didn't pay creditor.
What is the name of your state (only U.S. law)? IL
My fiances ex-employer went out of business last year and filed bankruptcy. It appeared that he had not been paying into his employees pensions, taxes, unemployment and now we just came to find out my fiances Wage Garnishments even though these were all deducted from his pay. The creditor has now frozen my fiances bank accounts and are pursuing the matter in court, he did not receive any prior notice of this. His prior employer should've have paid the creditor about $7000 and did not leaving my fiance owing all of the money again. The lawyer for the creditor said its my fiances problem and he has to take it up with his old boss. His old boss is bankrupt and has nothing so it cannot be taken from him. Is there any way my fiance is not responcible for paying this money again? Thank you so much for any help - we're desperate and cannot afford this.

Not sure but it seems if your fiance has his pay stubs showing the garnishments then he may be able to get out of it. But he has to have proof not just his word it was being deducted. I'm the kind of person that has pay stubs from 3 yrs ago. Why, I don't know but I fear something like that happening. Not wage garnishment since I haven't dealt with that but any type of nightmare.

I think it sucks that the creditor did not contact you to ask why the payments had stopped coming. If they had bothered to do that, you would have known there was a problem and could have addressed it before it came to this!
