I'm working as a delivery/stock man, for long, hard hours, from 8 am to at least 5 pm. It's very hard work, alot of heavy lifting and driving far distances (I don't drive, just move and physically deliver the products) sometimes even into other states for hours at a time. It's very hard work and my back is in pain and my body aches. I'm only getting paid 60 dollars a day for working from 8 am to 5 pm, and i only get paid an extra 10 if i were to work till 6 or even 7 for instance. He wants me to work at least 6 days a week, sometimes he even tries to convince to me to do 7 days, but i refuse to work a whole week cause my body needs rest. I'm didnt come in today on Saturday cause i was tired from this week and he screamed at me saying if i miss another day (on the weekend even after five days of work) he will fire me. I never agreed or volunteered to work on weekends, nor was i told it was a requirement for the job before i got it. I'm pissed and now looking for another job. I'm getting treated like an illegal immigrant and I'm american, born n raised and he is a greek immigrant. Am I getting paid less than Illinois minimum wage? I am paid in cash so there are no taxes which is good, but is it really that much better (60 dollars a day with maybe ten extra for working an extra hour or two)? There are no benefits or extra stuff that comes with the job either. How badly am I getting ripped off? Should I try and find another job, even during these economic hard times? Thanks.

If you're getting paid in cash and do not intend to claim it as income when you file your taxes, then how badly am I getting ripped off?

For discussion purposes, I'll assume you intend to claim the income.

Yes, you are being taken advantage of because he CAN - you've allowed it. If you're being paid in cash, you didn't accept a "job" per se; in other words, you're unlikely to be covered by unemployment insurance and/or workers compensation. If you have a day off, then peruse the classified ads for other employment. Be sure to get a new job before you leave this one and best of luck to you!

It doesn't hurt to look.
Before I quit, I would ask to talk to him and tell him you are dissatisfied - of course, he'll probably laugh his a** off, but on the other hand, all he can do is say "no." (to a raise, etc)
But if you feel you're being ripped off, you probably are. The burning question is, what else are you qualified to do?

Yes, you should definitely find another job!! That is a no brainer! But, stop crying over spilt milk.

You took the job knowing the low pay and long hours and very hard work.

I have done donkey work for low pay, but I knew I was doing it for a few days or few weeks or few months. Not forever.

Also, movers move on Saturday. But I woudl definitely insist on Monday and Sunday off. If you have enough time on the job, then if he fires you, you will get U.C., so then you can find another job.

Or you can bite the bullet and play along with your employer, until you find another job!!

And now we see, why we have unions, i.e. organizations of power, because...people are not fair, equitable, or do unto others as you would them do unto you, without being forced, consisently during good times and bad.

Thanks I should join the union now that i think about it. I actually had no idea what I was in for though when I took this job, all I knew was that I was desperate and needed money fast, all I was told was that the job payed "about 10 dollars an hour" whatever that means, which doesn't even matter cause it's completely false. I've talked to my employer about it and he says it "pays by the day" and not by the hour, which is 60 bucks from 8am to 5pm. I don't know what to do, no legit place is hiring, not even Burger King accepted me and I live in Chicago, this is rediculous. I'm thinkin I should join the union. Any idea on how the process works?

If you are working 8 to 5, with no break for lunch, then you are working 9 hours, for $60 that equals a pay rate of $6.675 per hour. If you are given an hour off for lunch and are working 8 hours then that works out to $7.50 per hour. The one thing to remember though, the minimum wage includes this guy paying for unemployment insurance, wc, and other stuff, so, he actually should be paying you $10 per hour to compensate for the things that he isn't paying. If he were paying you even minimum wage of $7.75 per hour right now, he would have to pay about $2 more per hour to the state to cover those required obligations. Which he aint. So he's getting off CHEAP!!!

You are seriouslly funny, but I also know you are not joking. But! You have to find a union job first, before you get to join the union, just in case you really didn't know...

P.S. regarding your hours and pay. Legally, they only have to pay you minimum wage. So, if you work 10 hours,you should get by law, 10 times @6.75 = @60. But it also depends upon your STATE. In Oregon minimum wage is @8.00 per hours, so that would be 80 dollars a day at 10 hours. Plus overtime, which is time and a half for the 2 x-tra hours.

p.s. When I did day labor, digging trenches, moving, painting, etc..They paid 7.00 dollars per hour, and the day labor place paid me 56.00 dollars per day and brought home 42.00 and that was with 5 exemptions...

just another thought...

funny, i tried getting a job in construction and they told me I had to join the union first, then apply. but ill figure it out. minimum wage here in illinois is 7.75 btw, so i am getting ripped off badly.

Yes, I think you are gettng ripped off badly but not illegally.

Everytime I have done a moving job, I have been paid between 10 to 15.00 per hour. (I was not a professional and I am female.)

But at the labor places they paid only minimu wage.

So legally, you are owed 7.75 times 8 hours equals 62.00 minus taxes = @45.00.

So you get out of paying taxes to the government and your employer does as well.

When I am broke I would prefer 60 bucks over 45! Until I can find a real job paying benefits, salary, etc...

but if you work over 8 hours, then YOU ARE getting legally ripped off, because that is an extra 23.25 for those 2 hours and a court, despite your irregularity, would cause the employer to pay you, your time and a half, for anything over 40 hours.

As you can see the law is tricky.... if this, then that, if that, then this.

p.s. I just remembered this...that you might not be eligible for U.C. if you and your employer decide to part ways, snce he is not paying u.c. tax for you...
