I've been off work through FMLA because of an event that happened to my family (home invasion). It has messed us up quite a bit and I've been home since mid-end of December. I have tried to get back in the routine, but there are so many things that my family needs (therapy, etc.) housing, job loss for hubby, etc. functioning at work hasn't been sucessful (I've tried to go back to work twice, but it's very distracting and difficult for me).

My family wants to relocate because of what happened (we feel maybe it is time) and start over with a fresh start where we feel safe. That would mean moving with no job, no residence, little savings, etc., but it would be mentally better for us.

My FMLA has now expired and I'm not sure what to do. Just wondering how HR/employer would view the situation. I've always worked and have a solid work history. I'm not trying to beat the system like I know people do, I just want my family to feel safe and secure and move on from a bad situation.

Any suggestions?

Well, I think the most secure move, would be to return to work and start look for a job elsewhere. If this means that your husband or family member takes you to work and picks you up, then do this for the next 3 monts while you look for work in another state or city or neigborhood.

Some jobs are better than others in transferable skillls to another geographical area.

However, since you have tried 2'x's already, the writing is probably on the wall, and your employer is probably looking for ways to get rid of you....and in terms of not being homeless, it is better to be terminated than to Quit!!!

Perhaps, your husband could move first and find a job in another geographical area. Then you and the children could follow in 6 to 12 months.

You could ask for a leave of absence. My last job would have done it for that reason, I think. It isn't paid, but it could give you more time to figure out your next step.

i see rkb0305 point, but the days of the understanding employer is less and less.

Personally, having worked in the legal field, I would not suggest that you put your status in any situation which is not protected by law, i.e. disability or long term leave rights... parituclarly in this economic climate, where employers are trying to lower their costs.

jsut a thought...

We recently had lay-offs and honestly it would have been better if I were one of the people they let go...

I hope that things work out for you and your family!!!! (but even though pride goeth before the fall, it is better to get terminated than to quit, before you have something permanently lined up.)

I know....How crazy would I be to ask to be laid off? They didn't let anyone go in my department and it is really slow..

I am currently out on FMLA. I have shingles in my throat,mouth and ear. The virsus has affected my inner ear and I am dizzy and can't walk without help. My 12 weeks is almost up. I am still under doctors care. When I use my leave up and I am still having problems with a doctors note, can them fire me? If they do can I draw unempolyment? We don't have disabilty at my job.

Your position can be restaffed or eliminated at the end of 12 weeks. You would likely not be eligible for unemployment until you were "able and available" for work.

Basically, once your doctor gives you a release to return to work, if there's no job to return to, you may be eligible for UR benefits - it will depend on the state in which you reside.

Is it realistic to think of moving when neither of you have any source of income? Who would rent to you?

One thing I think might be possible, is if you go back to work, in time you may find yourself lost in your work and not thinking about the event. You don't have that opportunity when you're not at work keeping busy with other things. And if you're still in the home where this happened, you're reliving it all day long.

I would try to go back to work knowing it's going to be tough initially but seeing if it eventually allows you some respite.
