Today was the last straw. I was accused of falsifying my timesheet (we fill it out ourselves in 15 minute increments).

Falsifying a timesheet is an offense punishable by termination, which is exactly what BD, my boss, is trying to do (i.e., fire me since HR must approve).

Anyway, this morning at 9 AM when I arrived, BD asked me what time I got in yesterday. I said 9:00 AM. BD said I got in after 9:30. I said I'm pretty sure I was here at 9 yesterday, and BD said I was not.

So I looked at WindowsUpdater.log and saw that Windows started at 9:05 AM (so I did get there at 9 AM given the small start-up tasks).

I printed it out and sent it to HR, and we are going to have a meeting about it.

There will only be two outcomes -- I get termination with severance (one month's pay), or I quit. I can give two week's notice and be immediately terminated with the two week's pay.

Sounds like all you have to do is show the windows data that proves you were at your desk at 9:05 and this is closed and your boss is obviously wrong. Unless of course just being at your desk doesn't constitute "being at work" in the eyes of your boss.

How do you know if you are terminated that you will get severance? They aren't required to give you any.

In the future a couple of responses if she accuses you of not being there at 9 (based on what BD said to you).

1. Damn you saw me at 9:30? I guess I have to find a better spot to hide to avoid you, I was hoping to not be spotted until at least noon.

2. Wow, that is the first time someone has ever blatantly called me a liar. (Then stick your fingers in your ears, make funny faces and yell liar, liar, your pants are on fire).

3. High-five BD and yell - Woohoo! Finally you can do something useful, read a clock.

If you get fired, you can draw unemployment, but if you quit, you can't. Better think about this carefully. It's hard to find jobs these days.

make sure you have a copies of your evidence. If HR sides with you, ask them in writing for a statement that you were cleared of the accusation. professionally and polietly, asked them for a copy of any evidence or statements your boss used to support his claim. if his evidence was based on nothing, ask HR what steps are being taken to prevent or discipline your boss for making a baseless accusation that could have resulted in your unlawful termination. mention that because your boss acted on baseless info, your concern that he may engage in other retalitory action that could lead to your termination. If his accusation was based on false information others provided or on information that was outside his control, go after those who provided the information or what steps are being taken to prevent a reoccurance. If you are fired, contact a labor attorney.

Not if you're fired for cause. This is why I want the severance -- besides the lump sum payment, big-company severance packages usually incude a provision that they won't contest an unemployment claim.

It's company policy to pay severance unless it's firing for cause.
