This visit was made to follow up to the risk factor assessment conducted on February 17 2016. The following corrective actions have been taken:
1. The beverage air 2 door refrigerator near the walk in refrigerator has been repaired and is now maintaining temperatures below 41°F. Thank you for making this repair
Please note the following issues:
- When thawing raw animal products like chicken in the sink, the food must be completely submerged under running water at a water temperature of 70°F or below with a sufficient velocity to agitate and float off loose particles of food as long as held for a period of time at a temperature of 41°F or less.

No violation noted during this evaluation.

This visit was made to conduct a risk based assessment. The following issues require attention:
1. Time/temperature control for safety foods (TCS) shall be properly cooled from 135°F to 70°F within 2 hours and from 135°F to 41°F within a total of 6 hours to prevent the growth of harmful bacteria. Cool TCS foods using the following methods:
a. placing foods in shallow pans
b. separating the food into smaller thinner portions
c. using rapid cooling equipment such as a walk-in cooler
d. keep food uncovered until properly cooled to 41 °F
e. using containers that facilitate heat transfer
2. Time/temperature control for safety foods must be held cold at 41°F or below. The 2 door Beverage Air refrigerator at the entrance to the kitchen is not functioning properly. Do not use this refrigerator to keep TCS foods. Have this unit repaired. A follow up visit will be conducted in approximately 3 business days.
3. Implement an Employee Health Policy that requires all employees to know the big 6 foodborne illnesses and all reportable symptoms and Certified Food Protection Managers to know when to restrict or exclude sick employees. Employee Health material was provided to facility and its requirements explained. The expectation is for all food employees to know the Big 6 illnesses and the reportable symptoms. Please review with all staff.
4. Facility will begin using Time as a Public Health Control Procedure for items on the prep counter including bean sprouts, cut tomatoes and cut lettuce. The procedure and requirements were reviewed with Person in Charge.
Notes:
- Obtain a food thermometer to ensure that proper food temperatures are taken and to properly monitor the cooling of foods
- Discontinue storing wet wiping cloths on the counter. Store wet wiping cloths in a sanitizing bucket. Utensil for cooking noodles should be kept in a clean dry location

    Observation: Observed through conversation that the Person in charge is not ensuring that employees are not using proper methods to rapidly cool Time/Temperature Control for Safety foods. In addition the establishment has no thermometer for monitoring the cooling process.

    Observation: Through conversation and/or review of written policy, it was determined that the establishment's employee health policy (EHP) is not compliant with the Food Code because: food workers were not able to correctly identify Big 6 Foodborne Illnesses and their symptoms.
    Correction: Create and implement an EHP that: 1) requires employees to report certain symptoms (vomiting, diarrhea, jaundice, sore throat with fever, or a lesion/infected wound) and illnesses (Norovirus, Hepatitis A, Salmonella Typhi, Salmonella, E. coli, or Shigella)

    Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: Observed raw meat being cut on a meat slicer directly next to the prep top unit which had ready to eat foods on top and was protected by only plastic. Also observed raw beef being stored over cooked beef in the 2 door prep top.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from all other foods such as cooked foods, ready-to-eat foods, washed produce, etc. Please relocate the meat cutting machine to be separated from the prep top unit and ready to eat foods. Person in Charge relocated the raw beef to be below the cooked beef.

    Correction: Refrigerated, ready-to-eat, potentially hazardous foods (time/temperature control for safety food) that are prepared on site and held at 41°For below shall be clearly labeled and date marked with a "USE BY" not exceeding 7 TOTAL DAYS. If the food is held for only 24 hours, no date marking is required.     Correction: Refrigerators shall be capable of holding foods at a temperature of 41°F or below. Repair the unit(s) immediately. Foods exposed to temperature abuse for over 2 hours shall be discarded, otherwise, the foods shall be stored in properly operating refrigerators.

    Observation: The faucet on the right side in the ladies room is spraying water.
    Correction: A plumbing system shall be maintained in good repair.

    Observation: The premises is not being routinely inspected for the presence of insects, rodents, and other pests.
    Correction: Insects and other pests are capable of transmitting disease to people by contaminating food and food-contact surfaces. Routinely inspect the premises to control the presence of pests on the premises.

For example, if using ONE shelving unit for storage of ONLY raw foods, the foods shall be sorted in this manner: 1) raw poultry (chicken, turkey, or duck) shall be stored on the BOTTOM shelf (165°F cook temperature), 2) raw ground beef and ground pork shall be stored on the shelf above poultry (155°F cook temperature), and 3) raw pork (chops, ribs), seafood, and shell eggs shall be stored on the top shelf above beef (145°F cook temperature).

    Observation: Observed food employees using improper handwashing procedures. Employee failed to wash her hands for 20 seconds. EHS trained the employee on proper hand washing during the inspection.
    Correction: ALL food employees shall wash their hands in the following manner: 1) remove and discard used gloves, 2) turn on warm water at the hand sink, 3) rinse hands/arms with warm water, 4) lather hands/arms with soap and scrub for at least 20 seconds, 5) rinse hands/arms with warm water, and 6) dry hands/arms with paper towels and then turn off the water at the hand sink using the paper towel. Effective handwashing will aid in the reduction of foodborne illness and is an important part of the food employee training program.

    Observation: A food employee failed to wash his or her hands before engaging in food preparation, after touching bare human body parts, after coughing, sneezing, eating, after handling soiled utensils, or after engaging in any activity that could contaminate the hands. Employee failed to wash his hands before putting on gloves. EHS instructed employees to wash their hands every time they change task.
    Correction: ALL food employees shall be washing their hands OFTEN especially after handling trash, using the rest-room, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction foodborne illness.

    Observation: Food employee(s) was observed handling the following ready-to-eat foods using their bare hands: lettuce. The employee washed her hands and put on gloves during the inspection.
    Correction: Except when washing fruits and vegetables, food employees may not contact ready-to-eat foods using their bare hands. Employees shall be using suitable utensils such as deli tissue, spatulas, tongs, or clean disposable gloves to handle all ready-to-eat foods. The establishment changed menu from Sushi to Vietnamese soup.
I observed the following and needed corrections:
1. The super size soup pots are too large for the 3 compartment sink basins to wash, rinse, and sanitize.
2. The gas burner stove left side is outside the hood system, about 6 inches outside.
3. Old equipment's from Sushi menu stored in the kitchen.
4. New equipment's added such as 2 large stoves and noodle boiler/ steamer.
Recommendations:
1. The soup pot can be sanitized by boiling plain water before preparing your soup broth. The lid can washed separately.
2. Remove one equipment to accommodate all the equipment's under the hood.
3. Remove all the old equipment's in the kitchen.
Notes:
Corrections must be made in 30 days.
Owner stated they will take one equipment.

    Correction: ALL food employees shall wash their hands in the following manner: 1) remove and discard used gloves, 2) turn on warm water at the hand sink, 3) rinse hands/arms with warm water, 4) lather hands/arms with soap and scrub for at least 20 seconds, 5) rinse hands/arms with warm water, and 6) dry hands/arms with paper towels and then turn off the water at the hand sink using the paper towel. Effective handwashing will aid in the reduction of foodborne illness and is an important part of the food employee training program.

This visit was conducted to complete a routine food safety evaluation.
1. On arrival, there was no CFM on site. It is a requirement that there is a CFM on site at all times when food handling is occurring. I strongly advise that you consider certifying other team members to ensure that you have adequate cover. The manager arrived a 90 minutes after the start of the evaluation.
2. Due to the on-going nature of the issues raised today, a risk control plan, in the form of a training exercise for your team must be implemented. Within the next 10 days, you must ensure that all team members receive training in hand washing, glove use and how to store food safely in the walkin cooler. This training must be documented and faxed to me within 10 days. I will conduct a follow up visit to check compliance.

  • Critical: Certified Food Manager: Presence Required (corrected on site)
    Observation: There was no Certified Food Manager (CFM) present at the beginning of the inspection.
    Correction: It is unlawful to operate a food establishment unless it is under the immediate control of a CFM. It is highly suggested that you have more than one employee with the food manager's certification. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in enforcement action.
  • Critical: No Bare Hand Contact with RTE Foods (corrected on site) (repeated violation)
    Observation: The sushi chef was observed preparing cucumbers with his bare hands.
    Correction: Except when washing fruits and vegetables, food employees may not contact ready-to-eat foods using their bare hands. Employees shall be using suitable utensils such as deli tissue, spatulas, tongs, or clean disposable gloves to handle all ready-to-eat foods. Proper handling of food and effective handwashing procedures will help prevent foodborne illness.

    Observation: Raw shrimp was observed stored on top of vegetables and raw shell eggs were observed stored above tomatoes in the walk-in cooler.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc.

This visit was conducted to complete a routine food safety evaluation.
1. You must ensure that the dish washer operative washes his hands after handling soiled equipment. However, progress had been made with other team members with regard to correct hand washing.
2. You must ensure that potentially hazardous food is kept at the correct temperature (41
°F
or below for your mussels and crab on the line).
3. Ensure that dishes containing previously cooked and cooled ingredients are re-heated to at least 165
°F
if being hot held on the buffet.
4. Progress had been made since your last evaluation, which was pleasing to see. Ensure that you continue to remind staff of the importance of hand washing and glove use.

    Correction: Cooling hot foods shall be accomplished as follows: 1) placing the food in shallow pans, 2) separating the food into smaller or thinner portions, 3) using rapid cooling equipment, 4) stirring the food in a container placed in an ice water bath, 5) using containers that facilitate heat transfer, 6) adding ice as an ingredient, or 7) other effective methods.
