Does it violate the TOS for someone to have a copyrighted image as their avatar/profile photo?

The Terms of Service state "Do not post copyrighted material." and "Copyrighted Material - Instead of copying-and-pasting articles, photos, or other material you find on the Internet, you should be posting links to those articles.

I always use photos I took or photos with granted permission such as Public Domain or Creative Commons - Attribution

Pancho so wouldn't that apply to a person using copyrighted material in their personal profile such as their profile photo?

Technically yes but since we don't allow avatars and profiles are often private (and even public are only visible to forum members) and not seen that often, a moderator might not look at it and unless we get a complaint from the image owner, it doesn't pose a danger.
