If a murderer of 4 (four) gets away with a life sentence ,in Alabama,then justice is in serious trouble...

Why did Abbot escape the death penalty ?

Any comments from people who know the case are welcome...

Well, God is the only judge as he can see what's in our hearts. So, rest assured that if God finds him guilty, his punishment in the afterlife will be much worse.

Disclaimer. Generally I'm against the death penalty for the reason stated above.

Is that how it works? Its been a long time since civics class, so all my knowledge on the matter comes from Law & Order marathons on TNT.

I thought a jury decides guilty or not, but a judge decides the sentence.

In Alabama, if it is a capital case (death penalty possible) then life without parole is also an available sentence. The jury determines the appropriate sentence. In Alabama there is also another step whereby the judge can either agree with the jury's finding, or substitute his own. That is why you'll see posts like the OP's post, and various letters to the editor, marches, etc. even after the jury has recommended LWOP -- they are hoping to persuade the judge to ignore the jury and impose the death penalty instead.

It's very difficult for judges (who are elected). If a jury imposes LWOP and a judge declines to impose death instead, he or she is almost guaranteed to hear about it come the next election -- "soft on crime", etc.).

That's why I asked why the jury imposed LWOP instead of death...

Does the law in Alabama require from jurors simple majority,super majority or unanimity in sentencing ..?

Maybe people in the South are finally realizing the death penalty is unnecessary and just causes more violence.
