I started working at Subway in April of 2014 . We got paid every two weeks, I was told that my first check would be held so that when I either quit or got fired we would get two checks.
I worked 6 months before finally getting sick of poor managment and numerous other problems. I had worked four or five days the week I quit. So I had about 20 hours or so. The next Tuesday I got my check for the days I had worked the week before I quit. I was expecting to get my last check, the one they held when I had first started working. Well, I go to get my check and my manager informs me that I do not get another check and he flat out tells me that he didn't even hold my first weeks pay. Which is a point blank lie. I called the owner of the Subway franchise numerous times and have heard nothing back. I did send an email to the labor board and asked them to contact me ; but I was just wondering if there was anything else I could do to ensure that I get my money.

You can call the Alabama Employment office. They should be able to tell you what the law is in AL. You will need proof that they did indeed with held the first check

Call the dept. of labor office. Employer MUST pay you in a timely manner.

Good luck and remember, always watch out for yourself. Get things in writing and keep copies of everything. This seems like a burden until you need them and then it feels really good to know that you have just what you need. Also, people are more forthcoming to help those who have shown willingness to make such effort.

Unfortunately, there is no such law that you must be paid in a "timely manner" in Alabama. Like many of the unfortunate backwards laws in our state, this is one that never seems to be important to our lawmakers. They seem to focus on only a few very conservative issues and never anything else.

I had a similar experience after leaving an employer and it was a horrible experience. They failed to have me sign a non-compete contract upon employment and after leaving they tried to make me sign one in order to get my final check. I told them I would not and they told me they would hold payment until I did. I later found out that I didn't have much recourse until they decided to pay me.

The result was a lot of mudslinging from me which eventually led to payment just to get me to shut up. I would be very persistent and not give up.
