Occasionally I'll see a vehicle (often a pickup truck) rolling down the road that looks crooked. I say to myself, I wonder if this person knows their vehicle has been in a serious accident and was not repaired right? I hope I'm never the buyer who gets gypped.

The title is a clean and by the way the seller acted when I spoke with him he knew of it . I spoke with some lawyers they said it wouldn't fall under the lemonlaw it falls under negligence and possibly malicious act they also told me to let dmv know the situation because it might have been in a hit and run judging the damage and that their wasn't a salvage title .So I know we got a case I'm trying to find a cheap lawyer or a problem bono I was gonna represent him but by law I cant

My son bought it off someone who posted it on Facebook he paid 6300 for it a reasonable person specially an 18 yr at that price would think it wasn't an unsafe vehicle it was taken to a certified frame specialist that's who told us it shouldn't even be on the road

The vehicle was sold as-is and you had the burden of doing due diligence prior to the sale. Your son failed to do so. You likely don’t have a case. No attorney will represent this for free, if at all. Please let us know how this pans out.

He can sue, but will he win? MAYBE.

If the vehicle was sold "as is", NO, unless he asked for confirmation that there hadn't been that type of damage and the information was not given to him.

If I were your son, I'd sue in small claims court and would allege "fraud in the inducement" if the vehicle was sold "as-is": the seller concealed information about the damage in order to deceive your son and close the deal.

If there was a representation made about the vehicle's condition and the representation was not accurate, I'd sue for breach of contract.
