Sounds like they have a judge ready to rubber stamp warrants for the blood draws 24/7, and in some counties will start the warrant application process as soon as you are pulled over.

Suppose you don't even drink but you get pulled over at a random check point. Can they still hogtie you, put you in a headlock and stick you with a big needle that you have no idea where it came from, and draw your blood?

Does it matter if your kids are in the backseat watching all this, or that you've got little one in the carseat? What if it makes you late to work and you lose your job? What if the headlock throws out a cervical disk in your neck and you wind up with a permanent injury? Suppose you are on a blood thinner? What is your remedy if you are totally innocent but still wind up being infected with a life long illness from a contaminated needle?

Not sure if serious. But some of those comments are legit concerns!

Whoa. If you refuse a breathalizer, you lose your license for a year anyway, right? This forced blood draw is crazy. Is it happening in Fulton now?

Well, yeah, I'm being serious, assuming that I'm correctly reading this thread. It seems crazy to have random DUI checkpoints where they can physically restrain you and force you to undergo blood testing.

K, the headlock comment threw me off. I don't know if they can physically restrain you and draw blood despite your refusal. My guess is that you give blood "voluntarily" or if you go to jail if you refuse. This sounds so creepy.

Oh, they will put you in a headlock and strap you down -- even if you don't resist.

That's exactly what they are doing. People who refuse to blow are being strapped down to a table & a nurse comes & takes two vials of your blood.

Right. My first thought was whether the state can even do this type of thing...legally.
