In 2014 a county mantained ditch\stormdrain overflowed and flooded my yard. Is the county responsible or should I just go ahead and pay for damages? Is getting flood insurance worth the price for future incidents?

I would get flood insurance if I owned a home. It just seems like the smart thing to do.

As with most legal questions, the answer is "it depends." Government entities generally have what is called sovereign immunity, meaning that they cannot be sued under a tort action. That said, most governments have enacted legislation that allowed civil actions under certain defined conditions, as a matter of public policy. You would have to see what Georgia state law says about government liability for damages resulting from a lack of maintenance of their property. You can probably get a free consultation from a plaintiffs attorney. Of course, it is free because they will take a sizeable portion of any settlement/award you receive.

That said, you do not have to wait for a legal decision to fix your property. Any money you spend to fix the damage can be recovered if there is a liable entity and favorable decision/settlement.
