They certainly could be. However in traffic there are certain advantages to scooters which I have mentioned above.

They have a top speed of 40 mph? A scooter engine that is capable of a higher speed requires the driver to have a motorcycle license.
There is no reason why anyone on a non-freeway roadway within an urban area, should be going faster than 35mph. Most streets, outside of a few major arteries, should be above 30 mph. I think bikes and cars can mix well if cars are going no faster than 35 mph.

Absolutely right. I'd personally prefer that cars stay under 30 mph in intown areas. There is no reason to be barreling around on urban streets.

The big advantage scooters and mopeds have is that they can easily move with auto traffic.

If I lived intown I would love to purchase a scooter, but I am not sure the Cobb County drivers ready to share the road with anything other than SUVs . Last summer while on the Amalfi Coast, I was amazed how many scooters were being ridden on those mountain roads. Actually saw a family of four (2 parents awith 2 small children) load up on one scooter, and ride off.
