I don't know. But I'm tired of losing. This city is starting to get pretty lame because all the best ideas get abandoned, killed or outlawed, while all the worst ideas get fast-tracked. I want to see things start happening that have the interests of the citizens prioritized over the interests of business.

If the greenway folks want to have their vision for the property realized, they will need to make an offer to the developer for the property. If that is rejected, I guess they could try to push the city or state to make some sort of claim of eminent domain, and force the developer to accept just compensation for the property.

The city cannot use eminent domain for greenspace. If Oakland Cemetery wants it so badly, why not do a land swap for their existing parking lot? https://www.google.com/maps/@33.7477...!3m1!1e3?hl=en

Why do you keep bringing up Oakland Cemetery? The Memorial Greenway is not a project of the Oakland Cemetery. Sure, Oakland could attempt to do a land swap, but saying things like "If Oakland Cemetery wants it so badly" is diversionary and seems like you have an agenda.

For eminent domain doesn't the state just have to show public use and public good? A park can be argued for both. Not sure how I feel about it--but, I think it would be a legal option.

Probably because the cemetery property and parking lot are owned by the CoA.

The city / park is already offering Pellerin more than they paid for the site.

There needs to be a system in place where a community can create a vision for future park land (or whatever growth they deem appropriate), and that vision can become a reality over a period of time even if the funding isn't in place from the start. Otherwise, the deck is stacked against communities.
