That's even worse. You burn you house down, you hurt yourself solely. You lower the value of the properties to discount the community unless you get what you want or they get rid of personels on HOA. Remember it's just a threatening.

Brilliant- and when they say "OK, go ahead and sell for whatever you'd like", then what? Other than looking like an idiot in front of the neighbors, what was accomplished?

I think it might be one of those times you just have to say this is crap and move on. Sounds like they made a mistake with letting him have that color and aren't willing to take that chance again. I don't have much experience with HOA's yet, my neighborhood is still being built, but I met some of my neighbors at a community get together and if some of them get on the board I will be scared.

You likely don't have a leg to stand on. Our covenants state that permission granted to one lot does not imply that permission will be granted for all lots. Besides, why do you want to copy your neighbor's paint job? Pick your own color!

Default Vote the HOA no power

To abolish an HOA you generally need unanimous consent of all the homeowners. This is very unlikely. You generally have an elite minority within the HOA that run for office and want to keep their power. My idea though is to gather a majority of homeowners together and at the next meeting vote to take away fees or make them $0. Then systematically strip the HOA of any other powers it may have. Including all of the fascist rules regarding house colors, pets, etc. Take them down to simply an HOA on paper with no power. I am thinking about doing this with my HOA. It seems that most people I know hate their HOAs so it seems theoretically possible.

Who keeps up then with all the fees associated with the community or the standards that are put in place for a reason?

You could just keep submitting requests for increasingly lighter colors until you get the maximum darkness they will allow

I think HOA has rules and regulataions filed with county where it resides in. In order to change them, I guess voting is required and documented with county afterwards. Well, in most circumstances, the rules and regulations are acceptable by residents. I also guess in other times we have to put up with things we don't like since we choose to live in a community and have to live the way we agreed upon.
