I am an owner of an unit in a condominium. I recently discovered serious termite and mold problems caused by the water damage due to the improper care of common areas including the gutter and poor landscaping works managed by the HOA. Now, HOA has agreed to repair the wall but will not restore my unit to live-in condition. It means that they will have to remove the sheetrock inside my unit so they can do the repair but they will NOT put a piece of good sheetrock back to my unit (just leave the wall inside my unit uncovered).
I discovered this problem when we are preparing the sheetrock for new paint to be appled. Anyone is familiar with this area? How can I fight back in a cost effective way.

Most condos have a repair and retreatment bond that should cover exactly that: repair and retreat. I would find out who the bond is with and call the termite company to see if it is covered. Is the HOA managed by a company or volunteer Bd of homeowners. Sometimes a volunteer Bd is not familiar with how a bond works but a management company should be.

Also, I would recommend you read your homeowner's manual and covenants to see what it says about this. There may be an exclusion on these items. If so, you're probably out of luck. You could also call the closing attorney you used when you bought the condo and ask them. Did you buy it from the builder or resale? If from a builder, was it less than 1 year ago? Most builders give a 1 year warranty.

Lastly, call your agent for assistance. They should be able to give you advice.

Do the HOA covenants say that the HOA is responsible for damage to balconies?

If so, I would try talking to the various HOA reps responsible for deciding what the HOA is responsible for repairing, and if you get nowhere with them, you might want to consider talking to a lawyer.

I'm a little surprised they don't have a termite bond that covers the repair or replacement of such structures.

I am a home owner and the condo developer controls the association and is about to go under, He is requesting that each homeowner give him $300.00 dollars so that he can pay the bills. He says there is no money left in the account. Can he make this request or should we fight this!

Is there no money because the money was spent by the HOA or by the developer for other things. A HOA board usually can access a special assessment within reason with larger ones requiring a vote by all.

Sounds to me like perhaps no board is in place and just maybe the funds have not been used strictly for the HOA as they should be. With the loss of income from foreclosures it is not unusual in these times to have a one time assessment to maintain reserves.
