It's interesting to note that Gabrielle Nestande's defense from intoxication manslaughter is that she was looking at her phone.

I guess only a Millennial could think there was a moral difference here.

I may be revising my opinion on these laws based on the outcome of this case. If she gets a pass based on killing someone because she was driving while texting vs. killing someone because she was driving while intoxicated. . .then I think we need to beef up the texting laws and revise the intoxication manslaughter law or have an equivalent law for people who kill while playing with their cell phones.

Why is there no mention of a blood sample? They didn't take one? Or, can we go with the reporting of this case is probably in error, (per another thread) anyway so we're wasting our breath speculating.

She left the scene of the accident and is wasn't until the next morning that the body was found and it wasn't until later in the day that the car was reported, and then it took some time to find out who it belonged to, etc. There likely wan't any useful sample

Well, with my bias and prejudice already out there, not to mention inaccuracies...it's sad all the way around. It's heartache no matter how you look at it. And just once I am going to contain myself and not respond to a post when I want to. There was a day, (thankfully not today) that could have been me sitting in her shoes,(the gal on trial) so I really should learn to keep my trap shut but I'm thick headed.
