Reading the "I need a bar" thread gave me the idea for this one.

Have your life ruined for at least a year, pay out thousands in lawyer fees, court costs, etc. and all based on a police officer's "suspicions.

Blow a 0.0? Blood test negative?

No matter to APD & the DA's office - you are still guilty of something and are going to jail:

Absolutely disgusting how the DWI/DUI has become a cash cow for the CoA.

And I am pro-law enforcement with two nephews who are police officers.

Running a stop sign does not merit being stuffed & cuffed and spending the night in jail. It is a ticket offense.

They charged him with a DWI based on no real evidence except "suspicion". And they didn't haul him off to jail for running the stop sign.

Any comment about that?

Plus the ADA approves of the action even though the driver was innocent of the DWI charge.

The CoA doesn't care when it deliberately ruins the lives of the little guy.

Apparently he was guilty of running a stop sign. But not DUI.

We are all likely guilty of something on a daily basis. But not DUI.

A person can be intoxicated by many things that don't show up on a breathalyzer. If the subject was behaving as if intoxicated, the police officer had a duty to take him off the street until they sober up. I'm glad they did.

This is why I have zero respect for the police. From the article - "Their position: If you look drunk, you will be arrested and the court system will work it out in the future". They should only be able to use the tools they have at their disposal. Not some far flung assumption. I can assume that all police are and corrupt and idiots too.

Note that was in no way a statement from the police, it was a statement of Tony Plohetski. In fact, given that he claims its "their position", the article is remarkably free of an actual quote from the APD as to what their position is.

I strongly disagree, if you are behaving in an intoxicated manner, I expect the police to take you off of the street, with my blessing.

Agreed. I noticed this statement in the article:

in an arrest affidavit that Davis, who told them he’d had only one drink, appeared intoxicated based on his performance in a field sobriety test.

The combination of running the stop sign and the poor performance in his field sobriety test left more than enough doubt that he could be impaired by something that didn't show up on the tests. I'm thankful they took him off the road under the circumstances. Can you imagine the blowback if they sent him on his way and got in an accident?

In the 1980s I had some dear friends who were killed when a drug impaired person crossed the median and hit them head on. That person would have passed those tests as well if he'd been stopped prior to the accident.
