If any of you rent out property how is it dealt with in Texas? Do you mind renting to smokers or do you want non-smokers?

I just found out that in other states you cannot "discriminate" by telling the potential renter they cannot smoke in your home that you are renting out. Whaaaaat?

I've had long periods of working in the cleaning business during my life and I can tell you smokers ruin everything in the home. It permeates absolutely every single thing. The water turns dark brown after just cleaning a few items. Walls? You have to change the water constantly.

Anyway, I'm off subject. Is it considered "discriminatory" here to rent homes and prefer non-smokers?

Which states? Do you have a source?

If the lease says "no smoking," it is prohibited. Simple.

My leases have a no smoking inside clause is how I deal with it here in Austin.

Yes, what states? Where are you getting your info? Smokers are not a protected class (yet) and can still be discriminated against everywhere, as far as I know.

This is not about discrimination. It's about what is or isn't allowed according to the terms of a lease. Just like whether a tenant can keep a pet.

Yes, I agree with much of what you are saying. I heard this from the rental agency we have in MI. I'll email them and ask them to send me some "proof". Might take awhile. Thank you for the responses. I'll post when I hear back.
