What makes you think that the law allows you two months at the old rate? August is the last month of your lease at the old rate. Since the landlord did not give you 30 day notice in advance of Sept. 1 you get that month at the old rate, but you don't get two months. A landlord is only required by law to give you 30 day notice to change the month to month rate.

If these folks don't live in Austin, any advice given by Austinites might not pertain to their circumstances.

State law governs - Texas Property Code.

I don't recall seeing anything to indicate they live in Texas...one shows location as SoCal.

My main point being...the Austin market(along with the regs) would determine a prudent course of action. It would be quite different in a city that isn't the fastest growing in the universe.
