This year, my son passed away while his truck was in the shop (nearly a year...long story). Fixed now and a dealer offered to pay off what is owed. We are more than happy to do that. It's been a long nightmare all around. The truck in registered in PA, but parked in NY at a relative's home. My son's name and my name are both on the title as well as the loan. To complicate matters even more, I now live in FL. Does anyone know the process of how the paperwork is exchanged and what is needed? Will I need only the death certificate? Power of Attorney was also mentioned by the dealer, but from what I understand, Power of Attorney only applies if the person is living. Any help here would be greatly appreciated. Thank you.
When someone dies without a will the power of attorney typically falls to the parents even without written consent. I just went through this with my mother 18 months ago. Her only asset was a car as well and when I went to re-register it all I needed was a copy of the death cert.
I showed the cert, showed my DL and signed the forms and paid the taxes. Was in and out in 20 mins. Work with the dealer. I'm sure they can handle all the paperwork for you. It sounds to me like you just want to be rid of the truck and profit is not a concern.. If money is a concern then it might be worth making the trip up and doing this in person.
