But it is a sliding scale, depending on the state, even if the other driver ran a red light, you could be partially at fault, if it is deemed that you could have avoided the accident
Unfortunately you are right. Some idiot can run a red light and if you could stop you must give them the right of way. That may be the law but it doesn't seem fair.
Lex i got no problem with your concerns about driver 2 not having a license, its all your other preconceived ideas as to the nature of driver 2 , i doubt the majority of people without a license would actually fit your description.

Just like with health insurance, a responsible person will have car insurance that is at least adequate for their situation.

Just like gambling casinos, the odds are rarely in your favor, so those with an adult-level of personal responsibility will carry car insurance, and health insurance, and home/apartment insurance that will take care of catastrophic problems.

Yes, so those that do have it should carry adequate levels of insurance for themselves, without regard to what others may or may not be carrying. Then you're OK.
Number #1 is sited for a law violations of no drivers license and #2 for failure to yield at redlight plus the fault in accident.

Driver #2 is the one w/o a driver's license.
Driver #1 is the one who ran the red light.
Driver #1 will be cited (you know--from the root word, "cite", which also gives us, "citation") for the red light violation, and will bear the liability for being the proximate cause of the collision.
Driver #2 will be cited for driving w/o a license.
"Sited", refers to location.
