This could , and probably does happen.
Jut a heads up, and something to really think about.

When I had new keys made for my MINI they wanted to see a copy of my driver license and a registration card with my name on it. They photo copied them and I had to wait 72 hours for new keys to be shipped from New Jersey. I'm not sure how anyone can bypass MINI/BMW's key ordering system, unless they have a man on the inside.

I'M sure places like Home depot, Lowes, and many locksmiths only require one thing when they make a duplicate key, and that is, money.

Most modern cars still require a key with a transponder.

I would hope that most dealers would ask for proof of ownership.

Unless the their had a friend at the dealer.

I'm willing to bet they can't cut a BMW, MINI, VW, Audi, Benz, Porsche key with a transponder.

At least here, the Lowe's self-service key maker doesn't accept car keys. (I don't have a transponder but I thought only dealerships would make copies of those?)

I just got a new key for my 2014 Ford. I had to get it from the dealership. I had to show my registration, which she checked out to see I was the correct owner, along with my drivers license. I dont mind them doing this. Just think of all the bad things that happened until they come up with all these checks.
