I sold my car to one of co-worker for $600 but later he was fired because of stealing. he was supposed to be pay me $50 every week. But because he did not have a job i was accepting late payment. The deal supposed to be done within 2 months. Now its been 1 year, he still owe me to around $200. I try to contact with him but he changed his home and phone number. The car is broken and i know where is the car now. Should i TOW the car and give his money back, or contact police. Please can anybody give me advice.

Uh, do you have anything in writing? If not, you'd be committing car theft.

If you have something in writing then sue him in Small Claims ... but then again, you can't squeeze blood from a stone.

Is your name still on the title and other legal documents?

Never sell anything without full payment in advance.

It was a learning experience, for only $200.00 and a lot of frustration, you learned the valuable lesson of NEVER lending money to anyone, friend or family. You will never get it back, just forget it and make sure never to do something that stupid again.
Ever hear the expression "Nice guys never win"? You just lost..!

I agree with most.....nothing in writing, your pretty much sunk. If you gave him a Bill of Sale, and he has it registered in his name, and no singed contract for payments.....not a good situation. Gotta watch more Judge Judy

No, you can't take the car (unless you still own it?) and the police won't be interested in a contractual dispute.

I suspect the best recourse is small claims court, assuming you have something in writing. It's usually cheap and easy to file but its a long process with an uncertain outcome so you may just want to file this under the 'life lessons learned' file.

Of course, going through small claims court is an education too which might be worthwhile learning now when the stakes are low so you're prepared if and when you have a problem worth real money.

Default Did you really sell it?

Only if you really sold it to him. Was there a bill of sale? Did you sign over the title?

If you are listed as the lienholder on the title, and have proof of payments, you can get it. If you pay a repo guy, that'll cost you a good bit.

Otherwise, you made a $200 error.

Do you still have title or lean on title? If so go get it and its up to him if he wants to go to civil court proving he has right to possess over you. Police are not going to get involved in civil matter.
