The seller did put some writing in the contract: " 2 month warranty, for you customer, if there are any problems come up, i will refund your money in 100%". Can i use this to get my money back?
You can try. Maybe go see an attorney for a consult. Or plan on small claims court.
Can you text the seller, and keep your texts and their responses saved in case you need it for evidence.
So how does the car have not have the salvaged box checked on the title if it's salvaged? Is it an old title or something? You can sue him if you can find him.
If he said the title was clean, you can pursue him for fraud. As is only applies if they did not make any affirmative representations. Apparently he did, so it was not an As-is sale.
Write him a letter and leave phone messages demanding a refund. If you know where he is, you can file a small claims court action if the amount of the sale was lees than the small claims limit. If not, you could try to file a court action in pro per, but you will probably need a lawyer and that may not be worth it.
Odd are, he will probably disappear and you will never find him again. If he disappears, you have no recourse. Even if you got a judgement, what would you do with it?
Don't you have the seller's address? What do you mean by "contract?" On the bill of sale? Is the seller a curbside dealer? NEVER buy from curbside dealers (especially on CL).
There is no valid legal contract, I'm sure: OP is a foreigner, based on the writing style, and got fleeced by what would have been obvious to most savvy Americans. I wouldn't pay "cash" unseen for any such thing, much less on CL, without various guarantees and other parties in-place. The only truly enforceable contract in a situation like that occurs via muscle/connections, which OP obviously does not have, as the original party was smart enough to immediately ghost post-sale. Probably has a burner cell, too, or if-not simply doesn't care.
Dump the car for fifty cents on the dollar in a couple years to some college kid, move on. That's life.
